Terms of Use

1. Who we are
WoFMate is operated by Michael Reece, trading as WoFMate ("WoFMate", "we", "us"), a sole trader based in New Zealand. These Terms govern your use of the WoFMate website and the WoFMate platform (together, the "Service").
By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the inspection organisation you represent.
2. The Service
WoFMate provides software for managing vehicle inspection workflows, generating inspection checksheets, and related compliance tooling for New Zealand inspection organisations.
Use of digital checksheets for regulated inspections is subject to the regulatory requirements that apply to you and your organisation, including NZTA requirements. You remain responsible for your own regulatory compliance, including the conduct of inspections and the obligations of your appointment.
3. Accounts and access
You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. Access levels within an organisation are controlled by that organisation's administrators.
4. Acceptable use
You must not misuse the Service — including attempting to access records or accounts you are not authorised for, interfering with the operation or security of the platform, or using it to create records that are false or misleading.
5. Your records and data
Inspection records created through the Service belong to the inspection organisation that created them. We process and store those records to provide the Service, including integrity controls such as automatic locking of completed checksheets.
Where regulatory requirements apply to inspection records (including retention and availability to regulators), the Service is designed to support those requirements, and you authorise us to make records available to authorised regulators where you direct or where we are legally required to do so.
6. Trials and subscriptions
Trial access is provided free for the stated trial period and may have feature limits. Paid subscriptions are billed per the pricing agreed at signup. We will give reasonable notice of pricing changes.
7. Availability and changes
We work to keep the Service available and performant but do not guarantee uninterrupted availability. We may improve or modify the Service; where a change materially reduces functionality you rely on, we will give reasonable notice.
8. Intellectual property
The Service, including its software, design, and content (excluding your records and data), is owned by WoFMate. You receive a non-exclusive, non-transferable right to use the Service for your organisation's purposes while your account is active.
9. Liability
To the maximum extent permitted by law, WoFMate's total liability arising out of or in connection with the Service is limited to the amount you paid for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or other non-excludable law. If you are using the Service in trade, the parties agree the Consumer Guarantees Act 1993 does not apply.
10. Suspension and termination
We may suspend or terminate access for material breach of these Terms. You may stop using the Service at any time; on termination we will make your organisation's records available for export for a reasonable period, subject to any regulatory retention obligations.
11. Governing law
These Terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after notice constitutes acceptance.
